Terms and conditions

These terms cover your use of thehut.company. They explain what the site is, what an inquiry is, and what still requires a separate written agreement.

Agreement

The site is operated by The Hut Company (“HUT,” “we,” “us”), 3046 W Stanford Dr, Englewood, CO 80110, United States. “You” means the person using the site, or the company or other entity on whose behalf you use it.

By using the site, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site. You must be 18 or older.

What the site is

The site presents HUT mountain homes and a way to begin a conversation. Two paths are described: a Custom home designed from the land, and a Signature House that already exists as a design and may later be licensed as drawn or adapted. HUT designs. Permitting and construction are carried out by licensed local professionals under their own agreements, unless a written agreement with us says otherwise.

The site does not sell subscriptions, houses, or a license to build. Choosing “purchase as designed,” “adapt,” or “start a project” sends a request. It does not complete a sale.

An inquiry is not an engagement

Sending a project inquiry, booking a conversation, or exchanging email does not make you a client, does not retain us, and does not create a duty to design, adapt, or build. We decide whether a project is one we can take on. Design work, a license to use a Signature House, and any construction role begin only when both sides sign a separate written agreement.

A time on the calendar is a conversation of about 30 minutes. It is not a deposit and not the start of services. We may reschedule or decline when the project is not one we can take. If these terms and a later written agreement ever differ, the written agreement controls for the work it covers.

What you see on the site

Drawings, models, photographs, film, dimensions, materials, timelines, and cost figures — including construction ranges — are illustrations. They are not a quote, a bid, or a promise that a house can be permitted or built on a particular site, on a particular schedule, or for a particular amount. Site conditions, codes, and the work of local professionals can change all of that.

Nothing on the site is architectural, engineering, legal, or investment advice for your land.

Our work

The site and what appears on it — designs, drawings, models, plans, photographs, film, and text — belong to The Hut Company or its licensors. You may look at them while you consider a HUT house. You may not copy them, publish them, or use them to design or build, except with our prior written consent. Looking at a house on the site does not give you a license to construct it.

What you send us

If you start a project, you agree that your name, email, and project details are accurate, current, and yours to share. You give us permission to use that information to review the project, reply, schedule a conversation, and, if we both choose to go further, prepare a proposal. You keep ownership of what you send. We will not publish your name or your note without your permission.

You agree not to misuse the site: do not attempt to access the studio or another person’s inquiry, do not probe or scrape the site, do not interfere with it, and do not send anyone else’s information without authority. We may refuse an inquiry or stop a conversation if these terms are broken.

Other sites

The site links to places we do not control, including Instagram, Pinterest, and the calendar used to hold a conversation. Their terms and privacy practices are their own. We are not responsible for them.

The site is provided as it is

The site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, error-free, or fit your project. We do not warrant that content is complete or current, or that the site is free of harmful code.

Some places do not allow certain warranty disclaimers. In those places, the disclaimers apply to the fullest extent they can.

Limits on liability

To the fullest extent the law allows, The Hut Company and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of the site or these terms. This applies even if we were advised that such damages were possible.

Our total liability for a claim arising out of the site or these terms will not exceed one hundred U.S. dollars (US $100). These limits apply to the site. They do not rewrite the liability terms of a later written agreement for design services.

Some states do not allow certain limits. In those states, liability is limited to the fullest extent the law allows.

Your responsibility

You will indemnify The Hut Company and the people who work with us against claims, damages, and reasonable expenses arising out of your misuse of the site or of our designs, or out of information you submit that you did not have the right to share.

Disputes

Colorado law governs these terms and your use of the site, without regard to conflict-of-laws rules. Courts located in the State of Colorado are the exclusive venue, except that we may seek injunctive relief where needed to protect our designs.

If you have a concern, write to us first at hello@thehut.company and give us 30 days to try to resolve it before you file a claim. Any claim arising out of the site or these terms must be brought within one year after it arose, unless a longer period is required by law.

If you are a consumer in the European Union, you still have the mandatory protections of the country where you live.

Trade restrictions

You represent that you are not located in a country subject to a United States embargo, or listed on a United States government list of prohibited or restricted parties.

General

If a provision of these terms cannot be enforced, the rest remains in effect, and that provision is read as far as the law allows. Waiting to enforce a right is not a waiver of it. You may not assign these terms. We may assign them if the business is transferred.

These terms are in English. If we provide a translation, the English text controls.

We may update these terms. The date at the top will change. If a change is material, we will make a reasonable effort to give notice before it applies. Using the site after the new terms apply means you accept them. The current terms are the entire agreement about use of the site.
